These General Conditions will expressly regulate the relationships arising between Coverbag Bcn, S.L. (hereinafter, “CoverbagCustom”) with CIF B65136913, registered in the Mercantile Registry of Barcelona, Volume 41349, Folio 0180, Sheet 391099, entry 1, with registered office at c/ Marqués de Monistrol, 7-9 Local, 08980 Sant Feliu de Llobregat (Barcelona), and third parties (hereinafter, “Users”) who register as users and/or purchase products (hereinafter, the “Products”) through the online store of the official CoverbagCustom website www.coverbagcustom.com (hereinafter, the “Store”).

1. General Conditions

1.1 This Legal Notice establishes the general conditions of use (hereinafter, “General Conditions”) that regulate the use of the services of the information society that CoverbagCustom makes available to Users through the Store. In this way, the access and use of the Store suppose that the User of the same fully accepts and undertakes to fully comply with the General Conditions in force at all times. In this way, the User is authorized to use the Store only in accordance with these General Conditions, as well as with the instructions, recommendations or particular conditions indicated in each specific case.

1.2 Access to the Store is free, except for the cost of connection through the telecommunications network provided by the access provider that the User has contracted.

1.3 Any User who accesses the Store as a User must be at least 16 years old.

1.4 CoverbagCustom reserves the right to modify the Store and its contents, including these General Conditions, at any time and without prior notice, so we recommend reading them before each access and navigation through the Store.

1.5 The User undertakes, in general, to use the Store to acquire the Products and to use each of the Store’s services diligently, in accordance with the law, morality, public order and the provisions of these Conditions. General, and must also refrain from using it in any way that could damage the image, interests and rights of CoverbagCustom or third parties, or that could injure or cause damage to the assets and rights of CoverbagCustom, its suppliers, Users or in general from any third party. Likewise, the User undertakes not to carry out any act in order to prevent, damage, disable, overload or deteriorate the normal functioning and enjoyment of the Store, or that would prevent, in any way, the normal use by the Users or the operation of it.

1.6 In the event that you breach these General Conditions or in CoverbagCustom we reasonably suspect that you are breaching them, CoverbagCustom reserves the right to limit, suspend or terminate your access to the Store, adopting any technical measure that is necessary for that purpose. Likewise, CoverbagCustom reserves the right to decide, at any time, on the continuity of the services it provides through the Store.

2. Intellectual and Industrial Property

2.1 The User acknowledges that all the elements of the Store and of each of the Products, the information and materials contained therein, the layout of the contents of the Store (sui generis right on the database), its graphic design (look & feel), the underlying computer programs (including source codes), as well as the different elements that make up the Store (texts, graphics, photographs, videos, sound recordings, etc.), are protected by intellectual property rights and industrial of CoverbagCustom itself or its licensors. With respect to the distinctive signs included in the Store (trademarks and trade names), they are the property of CoverbagCustom.

2.2 The General Conditions in no way attribute to the User with respect to said industrial and intellectual property rights any other right other than those specifically contemplated therein.

2.3 To this end, through these General Conditions, except in those cases in which it is legally permitted, the User is expressly prohibited from reproducing, transforming, modifying, disassembling, performing reverse engineering, distribution, rental, public communication, available, extraction and/or reuse of the Store, its contents and/or the distinctive signs of CoverbagCustom. The User must use the materials, elements and information that he accesses through the use of the Store solely for his own needs, forcing himself not to carry out, directly or indirectly, a commercial exploitation of the materials, elements and information obtained through the same.

2.4 The User must refrain from circumventing or manipulating any technical devices established by CoverbagCustom or by third parties in the Store.

3. Limitation of Liability

3.1 The User acknowledges and accepts that the use of the Store is carried out at all times at their sole risk and responsibility, for which CoverbagCustom is not responsible for the misuse or improper use that may be made of the Store. To this end, CoverbagCustom will only be responsible for the damages that the User may suffer from the use of the Store, when said damages are due to our malicious action.

3.2 CoverbagCustom will not be responsible for damages of any kind caused to the User’s computer equipment by viruses, worms, Trojan horses or any other harmful element. The User acknowledges that the use of the Internet network implies the assumption of a risk that their computer equipment may be affected by the aforementioned elements. For this purpose, the User is responsible, in any case, for the availability of adequate tools for the detection and elimination of harmful electronic programs.

3.3 CoverbagCustom will not be responsible for damages of any kind produced in the User that are caused by failures or disconnections in the telecommunications networks that produce the suspension, cancellation or interruption of the Store service during the provision of the same or with character previous. In this regard, the User acknowledges that access to the Store requires services provided by third parties outside the control of CoverbagCustom (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation does not correspond to CoverbagCustom.

4. Data Protection

4.1 In compliance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data and its development regulations, we inform you that the data you provide us through the registration form, as well as the of the transactions and/or queries made, will be incorporated into a file owned by CoverbagCustom, for treatment by this company with the exclusive purpose of developing and executing the sale, the personalized attention of the products and services that it acquires, as well as any other service necessary or related to the purchase through the Store.

4.2 All the data that we request is mandatory, in such a way that the omission of any of them could make it impossible for us to manage your purchase or provide the requested services. Please notify us immediately of any changes to your data so that the information contained in our files is up-to-date at all times and does not contain errors. In this sense, the User declares that the information and data provided to us are accurate, current and truthful.

4.3 Unless you indicate otherwise during the registration process, the User expressly consents that their data may be processed by CoverbagCustom to send them commercial information about our products and services by email, SMS, or any other equivalent electronic means of communication. In no case, your personal information will be transferred or sold to any other party outside of CoverbagCustom

4.4 The User may at any time exercise their rights of access, rectification, opposition or cancellation by contacting CoverbagCustom, at the aforementioned address, or by email to custom@coverbagcustom.com, accompanying in any case a copy of their ID or document official proof of your identity.

5. Passwords

5.1 CoverbagCustom will facilitate the use of personal passwords to the user who registers as such in the Store. These passwords will be used to access the services provided through the Store. The User must keep the passwords under their sole responsibility in the strictest and absolute confidentiality, assuming, therefore, any damages or consequences of any kind arising from the breach or disclosure of the same. For security reasons, the password for telematic access to the services linked to the Store may be modified at any time by the User. The User agrees to notify CoverbagCustom immediately of any unauthorized use of their password, as well as access by unauthorized third parties to it.

CoverbagCustom does not have any access to information related to the user’s credit card number. You only receive payment confirmation from the banking entities that process the payment.

6. Cookies

6.1 CoverbagCustom uses cookies in order to improve its services, facilitate navigation, maintain security, verify the User’s identity, facilitate access to personal preferences and track their use of the Store. Cookies are files installed on the computer’s hard drive or in the browser’s memory in the folder preconfigured by the User’s computer operating system to identify him.

6.2 If the User does not want a cookie to be installed on his hard drive, he must configure his Internet browsing program so as not to receive them. Likewise, the User may freely destroy cookies. In the event that the User decides to deactivate cookies, the quality and speed of the service may decrease and, even, they will lose access to some of the services offered in the Store.

7. Generalities

7.1 The use of the Store is governed and interpreted in accordance with Spanish law. In the event that any of the provisions contained in these General Conditions is declared invalid, it will be withdrawn or replaced. In any case, said declaration of nullity will not affect the validity of the rest of the provisions contained in these General Conditions.

CONTENT LIMITATIONS

CoverbagCustom will NOT accept

• Text or images that violate the intellectual property of others such as registered trademarks, copyright, industrial or intellectual property.
• Texts or images with names, company logos, products (for example Nike, Adidas…)
• Texts or images that glorify the use of violence, drug use, racism, sexism and terrorism or with hateful, insulting or discriminatory messages based on race, religion, sexual orientation or disability.
• Text or images that are pornographic or contain defamatory, threatening or insulting content.
• Inappropriate text or images of minors.
• Text or images that exalt or motivate to break the law.
• Any image or text that is considered at the discretion of CoverbagCustom as not acceptable according to the previous points, will be eliminated.
